Competition Terms and Conditions

3.1 General Requirements

• Minimum Age: Participants must be at least 18 years old at the time of participation.
• Residence: Eligible participants must reside in an EU member state, the European Economic Area (EEA), or Switzerland.
• Account: Participation requires a valid account on the respective platform (e.g., Instagram account).

3.2 Exclusions

The following are excluded from participation:

• Employees of BOTZILLA Ltd. and their relatives
• Employees of companies involved in the execution of the competition
• Persons using automated services, bots, or competition services
• Persons with fake accounts or multiple accounts
• Legal entities and partnerships

4.1 Method of Participation

Participation is achieved by fulfilling the conditions stated in the respective competition post, such as:

• Liking the post
• Commenting on the post
• Tagging other users
• Sharing the post (in story, feed, etc.)
• Following the account
• Answering a question
• Submitting photos/videos

4.2 Conditions of Participation

• Participation is free and not dependent on any purchase.
• Only one entry per person is allowed unless otherwise stated.
• Participation must be personal.
• The participant's account must be public for verification purposes.
• Participation must occur within the specified time frame.

6.1 Winner Selection

• Winners will be selected after the participation period ends.
• Selection is made randomly from all valid entries (e.g., using a random generator).
• For creative competitions (e.g., photo contests), selection may be made by a jury.

6.2 Notification

• Winners will be notified via direct message (DM) on the respective platform or by email.
• An optional public announcement may also be made in the competition post or story.
• The winner must respond within 7 days and provide their contact details for prize delivery.
• If no response is received within this period, the prize claim expires and a substitute winner will be selected.

6.3 Prize Delivery

• Shipping is free within the EU/EEA/Switzerland.
• Additional costs may apply for shipping outside these areas, to be paid by the winner.
• Digital prizes will be delivered by email.
• For experience prizes or vouchers, the respective provider's terms apply.

8.1 General Disclaimer

The organizer is not liable for:

• Technical failures or outages of the respective platform
• Loss, damage, or delay of messages
• Data transmission errors
• Server outages or technical problems
• Errors or disruptions in prize delivery by third parties (e.g., shipping carriers)

8.2 Limitation of Liability

• The organizer's liability is limited to intent and gross negligence.
• Liability for slight negligence is excluded to the extent permitted by law.
• This does not apply to injury to life, body, or health.

8.3 Prize-Related Liability

• The organizer assumes no liability for defects in the prize.
• For experience prizes or vouchers, the liability provisions of the respective provider apply.
• The winner is solely responsible for the use of the prize.

10.1 Data Collected

The following personal data is collected in connection with the competition:

• Username/profile name on the respective platform
• For winners additionally: First and last name, email address, delivery address

10.2 Purpose of Use

Data is used exclusively for:

• Conducting the competition
• Determining the winners
• Notifying and contacting winners
• Delivering the prizes

10.3 Retention and Deletion

• Data will be deleted after completion of the competition and prize delivery.
• Statutory retention periods remain unaffected.
• Deletion occurs no later than 6 months after the competition ends.

12.1 Legal Recourse

Legal recourse is excluded.

12.2 Applicable Law

Irish law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, the mandatory provisions of the country of their habitual residence remain unaffected.

12.3 Severability Clause

If any provision of these terms and conditions is or becomes invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that most closely reflects the economic purpose of the invalid provision.
