Platform Liability
Mallorca Map is a hosting platform under EU E-Commerce Directive. We respond promptly to copyright violation reports (Notice & Takedown procedure).
2. Platform Content & Data Sources
Mallorca Map is an information platform that aggregates data from various sources to provide users with a comprehensive overview of Mallorca.
Aggregation of Public Data
We collect and structure publicly available information from the internet, including:
- Factual data: Titles, addresses, opening hours, phone numbers, dates
- Descriptions: Publicly available business information
- Images: Publicly accessible photos (with source attribution)
- Event data: Events, dates, locations
This data collection is for information purposes and corresponds to the legitimate business model of directory and information platforms.
Source Attribution
Where legally required or technically possible, we provide the source of information:
- Images are credited with source attribution
- Events link to the original source (when available)
- Business information comes from public registers or websites
Factual Information
Legal Notice: Pure facts such as addresses, phone numbers, opening hours, or dates are not protected by copyright (ECJ case law C-604/10 "Football Dataco"). However, the compilation of this data in our database is protected by database maker rights (EU Directive 96/9/EC).
Notice & Takedown for Source Content
If you believe we are using your copyrighted content without authorization:

- We review your request within 72 hours
- For legitimate claims, we remove content or add source attribution

User-Generated Content vs. Platform Content
Mallorca Map contains two types of content: (1) Data aggregated by us from public sources for basic information and (2) User-Generated Content (reviews, comments, uploaded images). Users are responsible for user-generated content, not the platform (hosting privilege under E-Commerce Directive).
3. File a Copyright Complaint
Step 1: Send Email
Step 2: Required Information
- Identification of the copyrighted work (description + proof of ownership)
- URL of the infringing content (direct link + screenshot if possible)
- Your contact information (name, email, address)
- Statement: "I declare that the information is accurate and I am the rights holder or authorized to act on behalf of the rights holder"
- Signature (digital signature / typed name is sufficient)
4. Processing Time
⏱️ Response within 72 hours
- We review your complaint for completeness (within 24h)
- If incomplete: Follow-up email
- If complete: Content removed or reviewed within 72h
- You receive a confirmation email with the result
5. Counter-Notice
If your content was removed and you believe it was a mistake, you can file a counter-notice:
- You own the rights or have permission
- Use falls under fair use
- Copyright claim is unjustified
Processing time: 5-7 business days
6. Repeat Offender Policy
- 1st offense: Warning + content removal
- 2nd offense: 7-day ban
- 3rd offense: Permanent account ban
